Terms of Service · Effective September 15, 2026
The deal, in plain English.
These terms cover the webbynd.com website, our text-message program, and the systems Webbynd sells to businesses. "Webbynd," "we," and "us" mean Quantum Consulting LLC, a Nevada company doing business as Webbynd, at 930 S 4th St, Ste 209, Las Vegas, NV 89101. "You" means the person or business reading this or buying from us. By using the site, texting us, or buying a plan, you agree to these terms. If you do not agree, please do not use the site or the services.
1. The website
webbynd.com is a marketing site. The numbers, case studies, and comparisons on it are accurate to the best of our knowledge and sourced where we can source them, but they are general information, not advice for your specific business, and not a promise of the results you will get. Links to other sites are provided for convenience; we do not control those sites.
Everything on the site (text, design, images, code) belongs to Webbynd or is used with permission. You may read it, share links to it, and quote short passages with attribution. Please do not copy pages wholesale.
2. Text messages from Webbynd
Program name: Webbynd Messages.
What you will receive: replies to your questions, booking confirmations and reminders, follow-ups about a system you asked about, and account or service notices if you are a client.
Opting in: you opt in by checking the SMS consent box on a webbynd.com form, by asking us to text you on a call, or by texting us first. Consent is not a condition of purchase.
Message frequency varies. Expect up to 4 messages a month, plus replies to messages you send us.
Message and data rates may apply.
Opting out: reply STOP to any message. You will receive one final confirmation text and then nothing further.
Help: reply HELP, email hello@webbynd.com, or call (949) 396-9452.
Carriers are not liable for delayed or undelivered messages.
How we handle your number is covered in our Privacy Policy. We never share mobile numbers or texting consent with third parties or affiliates for their marketing.
3. What we sell
Webbynd sells phone and messaging systems for service businesses. The current plans are:
- Text Back — a text goes out within seconds of any missed call, with a booking link and a two-way inbox.
- Call Back — an AI agent calls the missed caller back within about a minute, between 8am and 8pm local time, once per number per day, and texts instead outside that window.
- Never Miss a Call — an AI receptionist answers around the clock, qualifies the caller, books into your calendar, and texts you a summary. Includes Text Back and Call Back as fallbacks and a set number of answered calls per month.
- Never Miss a Call Pro — everything above with a higher call allowance, up to three lines or locations, a custom script, CRM integration, and priority support.
Prices, call allowances, and overage rates are the ones shown on the order page or written proposal you accepted. The written proposal wins if the two differ. We also sell custom builds and monthly management under separate written agreements; those agreements control for that work.
4. Billing
- Subscriptions renew automatically, monthly or annually, until you cancel. You authorize us and our payment processor (Stripe) to charge the card on file.
- Setup fees are a one-time charge for onboarding and configuration. They are earned once onboarding starts and are not refundable after that point.
- Annual plans are prepaid at ten months for twelve. They are not refundable after the first 14 days, except as the law requires.
- Overage. Each plan includes a number of answered calls (and, on Text Back, a fair-use allowance of texts). If you go over, we bill the per-call or per-bundle rate on your plan. We will text or email you before an overage is ever charged, and moving up a plan is always cheaper than paying overage.
- Usage costs for calls, texts, and AI minutes are passed through at our cost with no markup unless your plan says otherwise.
- Price changes. Your plan price is locked for 12 months from signup. After that we may change it with 30 days' written notice, and you may cancel before the change takes effect.
- Failed payments. If a charge fails, we retry and email you. After 7 days without payment we may pause the system until it is paid. We will never turn off your phone number without telling you first.
- Taxes are added where required.
5. Cancelling
Cancel any time by emailing hello@webbynd.com. Cancellation takes effect at the end of the billing period you have already paid for; we do not refund partial months. After cancellation you have 90 days to export your contacts, conversations, and recordings. After that we delete them, except records we are required to keep.
We may cancel or suspend service, with notice where practical, if you break these terms, if your use puts our phone numbers or carrier standing at risk, or if payment is more than 30 days late.
6. Your responsibilities
The systems we build send texts and make calls under your business name, so most of the legal responsibility for how they are used sits with you. You agree to:
- Get consent. Only text or call people who have given your business permission to contact them, as the Telephone Consumer Protection Act, the CAN-SPAM Act, carrier rules, and your state's laws require. Missed-call text-back replies to someone who just called you; broadcast or cold messaging needs its own written consent.
- Honor opt-outs. Anyone who replies STOP stays stopped. The system does this automatically; do not work around it.
- Register truthfully. Carriers require every business texting in the U.S. to register (called A2P 10DLC). You will give us accurate business information for that registration, and you understand that texts cannot go out until the carriers approve it, which is outside our control.
- Tell callers about the AI. The AI receptionist identifies itself as automated. Do not ask us to remove that disclosure. Where call recording is turned on, you are responsible for any consent your state requires.
- Keep it lawful and decent. No use for anything illegal, deceptive, harassing, or that violates someone's rights. No sending of content that carriers prohibit.
- Not rely on it for emergencies. The system is not a 911 service and is not monitored by humans in real time. Do not use it for anything where a delay could hurt someone.
- Follow your industry's rules. If you are a law firm, the AI handles intake only and does not give legal advice; you are responsible for how you use what it collects. If you handle protected health information (dentists, chiropractors, med spas, and similar), our standard plans are not set up for it. Do not route medical details through the system unless we have signed a written agreement covering it.
- Keep your account secure. You are responsible for the people you give login access to.
7. Our responsibilities
- Onboarding. Every plan starts with an onboarding call within 7 days of signup. Nothing goes live until that call has happened.
- Support. Email and text support Monday through Friday, 9am to 6pm Pacific, with a one-business-day response target. Pro plans get priority.
- Reporting. Clients on Never Miss a Call and Pro get a weekly scorecard (calls answered, missed calls texted, appointments booked).
- Reasonable care. We build and run the system with reasonable skill and keep it working. The system depends on phone carriers, HighLevel, Twilio, Stripe, and the internet, none of which we control, so we do not promise it will never be down. When something breaks on our side, we fix it as fast as we can and tell you what happened.
8. Who owns what
- Your data is yours. Your contacts, conversations, recordings, appointments, and business information belong to you. You can export them at any time and for 90 days after you leave.
- The system is ours. The scripts, prompts, workflows, automations, templates, and configuration we build are Webbynd's toolkit. You get a license to use them for as long as you are a client. You may not copy them, resell them, or hand them to another provider.
- Phone numbers. Numbers we provision for you are yours to keep. If you leave, we will cooperate in porting them to another carrier within carrier rules. Numbers you bring to us stay yours.
- Your name and logo. We use them only to run your system. We will not name you as a client publicly without your written OK, except under a founding-client agreement you have signed.
9. No guarantees of results
We publish real numbers from real clients, with their permission, because we think you should see them. They are not a promise. How many calls you get, how many book, and how many become customers depends on your business, your market, and your follow-through. We do not guarantee revenue, leads, appointments, rankings, or any particular outcome.
10. Warranty disclaimer
Except as this page says, the website and services are provided "as is." We disclaim all other warranties, express or implied, including fitness for a particular purpose and non-infringement, to the extent the law allows.
11. Limits on liability
To the fullest extent the law allows, Webbynd is not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost business, or lost data, arising from the website or the services. Our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim arose. Nothing here limits liability that cannot be limited by law.
12. Your indemnity
Because the system sends messages and makes calls in your name, you agree to defend and reimburse Webbynd for claims, fines, and costs (including reasonable attorney fees) that arise from your contacts, your consent practices, your registration information, or your use of the system in violation of section 6 or the law.
13. Disputes
If something goes wrong, email us first. Most problems get fixed with a phone call. If we cannot resolve it within 30 days, these terms are governed by the laws of the State of Nevada, and any lawsuit will be brought in the state or federal courts in Clark County, Nevada. Each of us gives up the right to a jury trial to the extent the law allows.
14. Changes to these terms
We may update these terms. When we do, the effective date at the top changes, and we will email current clients about anything meaningful at least 30 days before it applies to them. Continuing to use the site or services after that date means you accept the new terms.
15. The rest
These terms, your order or written proposal, and our Privacy Policy are the whole agreement between us. If a court finds one part unenforceable, the rest still stands. You may not transfer your account without our written OK; we may transfer these terms if the business is sold. Neither of us is responsible for delays caused by events outside our reasonable control.
